Contest Rules for #SANDCRAFTSendIt

IMPORTANT NOTE: Please read these Rules very carefully before you submit your photo or video (all together referred to as the “Entry”).

You, as the entrant in this Contest (referred to as the “Entrant”), must read and agree to these Terms before submitting an Entry. By completing and submitting an Entry, Entrants are deemed to have confirmed that they have read, understood and unequivocally accept all of the Terms of this Contest and meet the eligibility requirements.

1). Final decision: The decisions of Sandcraft LLC, 4025 E. Madison Street, Phoenix, AZ 85034 (the “Administrator”), are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. No decisions of the Administrator or any of the judges associated with the Contest may be challenged on any ground, including without limitation, failure of the Administrator to act reasonably, fairly, in good faith, or in accordance with the principles of procedural fairness; and the Administrator’s decisions will remain binding and conclusive even if those decisions were allegedly or actually wrong or based upon error or otherwise based on any unreasonable, irrational, or irrelevant consideration.

2). Odds: The odds of winning will depend on the number of eligible entries received. Limit one entry per valid e-mail address and photo entry. Administrator will select three winners per Contest Period out of all eligible entries received.

3). Eligibility: The Contest is open only to legal residents of the United States who are EIGHTEEN YEARS OF AGE OR OLDER at the time of entry. The Contest is void where prohibited or restricted by law. The Contest is sponsored by Sandcraft LLC. The Administrator will be responsible for verifying that all Contest entries submitted comply with these Official Rules. All directors, officers and employees of the Administrator, and any respective parent companies, subsidiaries, affiliates, sales representatives, distributors, licensees, agents, advertising and Contest advisors, and each of their respective immediate family members (spouses, parents, children, and siblings and their respective spouses), and those living in the same household as each, are not eligible to participate in the Contest.

4). Contest Period. This Contest will begin at 12:01 a.m. Mountain Standard Time (“MST”) on October 26, 2019 and end at 11:59 p.m. MST on December 28, 2019 (the “Contest Period”). The Administrator’s computer system shall be the official timekeeper.

5). Description of Contest. This Contest is for anyone who meets the eligibility requirements. Administrator is seeking compliance with Contest Rules in determining winner.

6). How to Enter the Contest: To enter the Contest, during the Contest Period Entrants must:

a) Like and follow Sandcraft on either Facebook and Instagram

b) Visit & check in to Sandcraft Point at the top of Oldsmobile Hill

c) Go to the Sandcraft RCR Facebook Page to the top pinned post, and comment on that post with either a picture or video of you hucking off Sandcraft point using the hashtag “#sandcraftsendit”. Alternatively, you can tag a picture or video of yourself on Instagram hucking off Sandcraft Point, tagging @sandcraft_rcr with “#sandcraftsendit”.

7). Contest Rules.

a) All Entries must be original work of the Entrant;

b) All Entries must have been taken by, or on behalf of, the Entrant subsequent to October 22, 2019;

c) If the Entrant is not the person featured in the Entry, the Entrant must have written permission from the subject of the Entry to use their image as the Entry;

d) If you are submitting a video as your Entry, it must not be longer than 30 seconds;

e) No trademarked or copyrighted art, graphics, images, content, pictures, video or audio shall appear in any Entry, or all required permissions have been lawfully acquired by the Entrant;

f) No disparaging remarks by the Entrant regarding any Entrant or the Administrator may be made on the Sandcraft Facebook Page, Sandcraft Instagram Page, or the Sandcraft website during or after the Contest Period;

g) Entrants shall not provide any false information about themselves, the Contest, or the Administrators to the public or to the Administrator;

h) All of Administrator’s trademarks must be used appropriately;

i) Administrator’s prior written approval is required before providing interviews or public comment related to the Contest;

j) The Entry may not violate any applicable law or regulation (including any laws regarding anti-discrimination or false advertising);

k) The Entry may not be explicit, obscene, violent or pornographic;

l) The Entry may not contain any viruses or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, date or personal information; and

m) One entry per person.

8). Breach of Contest Rules. Entrants acknowledge that any breach or violation of these Official Rules, or a third party asserting rights to any work, shall immediately disqualify the Entrant during any phase of the Contest. Administrator is not responsible for any entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion, or incompatibility at any Administrator’s servers or elsewhere, which entries are void.

9). Contest Administrator. Sandcraft LLC will act as Contest Administrator and will be the final arbiter of compliance with Contest Rules. This Contest is in no way sponsored, endorsed, administered by or associated by Facebook or Instagram.

10). Winner Selection. Once the competition is closed at the end of the Contest Period, Administrator shall select three winners of the Contest that, in its sole discretion, best demonstrate the spirit of “SandcraftSendIt (the “Winners”). The selection of the Winners is at the sole discretion of Administrator, and the decision of Administrator is and will be final. One winner will receive $1,500.00 (USD) of Sandcraft products, the specific products to be chosen at the discretion of the Administrator (the “Contest Prize”). One winner will receive $1,000.00 (USD) of Sandcraft products, the specific products to be chosen at the discretion of the Administrator (the “Contest Prize”). Winner is responsible for any and all federal, state, and local taxes that may be associated with the Contest Prize. The Winner is responsible for moving or otherwise relocating the Contest Prize from the location designated by the Administrator to the Winner’s residence. No transfer, assignment, or substitution of a prize is permitted except by Administrator who may substitute the Contest Prize with one of comparable or greater value, at its sole discretion.

11). Warranty: By entering the Contest, each Entrant represents, warrants and covenants that (i) each Entry, or any portion thereof, is the Entrant’s original work and does not infringe upon or otherwise violate any right of any third party, including any copyright, trademark or other intellectual property rights; (ii) each Entry, or any portion thereof, has not been previously published and the Entrant shall not submit the Entry, or any portion thereof, to any other contest or publication; and (iii) the Entrant has the right and power to enter the Contest and perform all the obligations.

12). Ownership/Use Rights: SUBMISSION OF AN ENTRY IN THIS CONTEST CONSTITUTES ENTRANT’S IRREVOCABLE AND EXCLUSIVE ASSIGNMENT TO ADMINISTRATOR OF ALL RIGHT, TITLE, AND INTEREST OF SUCH ENTRY AS OF THE DATE OF SUBMISSION, INCLUDING, WITHOUT LIMITATION, COPYRIGHT. The Entrant agrees that Entrant (or any other third party) does not retain any rights to such Entries or other materials. Entrant agrees to execute such assignment or other documents as are necessary to enforce the rights of Administrator granted herein without any compensation of any kind to Entrant, his/her successors or assigns, or any other entity. By entering the Contest, each Entrant agrees that Administrator shall have the right, but not the obligation, to edit, remove, modify, publish, license, print, transmit, display or otherwise use any submitted Entry, and all accompanying personally identifiable information Entrant submits, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation to Entrant, his/her successors or assigns, or any other entity, except where prohibited by law. Entrant waives any retained rights of attribution, privacy, publicity, withdrawal, integrity or other moral or personal rights in the Entry, entry-forms and other related materials. All Entries, entry-forms and other related materials become the property of Administrator and will not be returned to any Entrant. If Administrator requests the Entrant’s cooperation in promoting the Contest, the Entrant agrees to reasonably be available for such promotional activities.

13). Privacy: By participating in the Contest, Entrant authorizes Administrator to collect, use, process, transfer and store all data provided by Entrant, including without limitation, personal data, to the United States, or any location(s) throughout the world that Administrator deems necessary, whether within the United States of America or elsewhere, and with such parties as Administrator deems appropriate, for purposes of administration of the Contest. All information submitted to Administrator as part of this Contest will be treated in accordance with Administrator’s privacy statement, available at www.sandcraftmotorsports.com and clicking on the “privacy policy” link. Personal information will be used only to: (a) provide information about the Contest; and/or (b) contact and publicize potential winners. Entrants to the Contest may receive commercial e-mails from Administrator; however, eligibility to participate in the Contest is not dependent upon the Entrant’s consent to receive such e-mails.

14). Release and Limitations on Liability Relating To The Contest. By participating in the Contest, the Entrant agree to release and hold harmless all directors, officers and employees of Administrator, and each of their respective parent companies, subsidiaries, affiliates, sales representatives, distributors, licensees, agents, advertising and Contest agencies, along with Facebook and Instagram (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, incorrect, garbled, or incompletely received entries; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or acceptance, receipt, use, or misuse of any prize; or travel to any Contest-related events; and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, defamation or invasion of privacy and merchandise delivery. Each Entrant further agrees to release the Released Parties and their designees and assigns from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses and damages of any kind arising out of or in connection with the Contest or acceptance, possession, or use of any prize (including, without limitation, attorneys’ fees, claims, costs, personal injuries, losses and damages related to personal injuries, death, damage to or destruction or property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Administrator is not responsible if any prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.

15). Cancellation, changes or substitution. Administrator reserves the right to cancel this Contest, or change or vary any condition or requirement of this Contest in any way it deems fit, without notice.

16). Miscellaneous. The decisions of the Administrator are final with respect to all aspects of this Contest. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the State of Arizona, without regard to choice of law principles. In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of the Administrator that may cause the Contest to be disrupted or corrupted, the Administrator may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize from among the non-suspect, eligible Entries received up to the time of the impairment. Administrator reserves the right in its sole discretion to disqualify any Entrant it finds to be tampering with the entry process, the operation of the Contest, to be acting in violation of these Official Rules or any applicable laws relating to the Contest, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion. In the event of a dispute as to any Entry submitted, Entries submitted will be deemed made by the authorized account holder of the e-mail address submitted at the time of Entry. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof of being the authorized account holder may be required. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event an insufficient number of Entries are received, Administrator reserves the right to cancel the Contest and shall be under no obligation to award the prizes.

17). Winners List. For the names of the winners, send a self-addressed, stamped envelope to: Sandcraft LLC, 4025 E. Madison Street, Phoenix, AZ 85034. The names of the winners will be available for 60 days after winner selection. Please allow 6-8 weeks for delivery.

18). Sponsor(s). The Sponsor of this Contest is Sandcraft LLC. Entrants shall not use the trademarks of Sponsor or falsely associate themselves with any Sponsor during or after the Contest Period.
